Probate

Probate is a legal process where the court oversees the distribution of assets left by an individual. A probate is not always necessary. If the individual has non-probate property such as bank accounts or property owned jointly with another, these assets often pass automatically without a probate being filed.

Depending on the value of the assets left, a Small Estate Affidavit can be used to pass your assets to loved ones.  For a further discussion of the Small Estate Affidavit, view the link below.  For a general discussion of probate, see Probate in Oregon.
